City employee's due process rights are violated when he is laid off without being provided a hearing in which to present his side of the story, even though union contract stated that employee was not entitled to pretermination hearing in the event of lay offs. But neither his supervisor, nor the city are liable in damages, the supervisor being entitled to qualified immunity, and the city having no policy amounting to deliberate indifference to the employee's constitutional rights.
